Abstract
Critical analysis about Bentham’s objections against the 1789 French
Declaration of the Rights of Man and of the Citizen, on the basis of comparison
among the main legal and philosophical currents of the Enlightenment. The article
seeks to find out if the Benthamian criticism had in mind the material content of
human rights or just the formal dress they were wearing. Finally, a methodological
examination is made of both those objections and the material that served them as
an object.
